Community Right to Build Order at Phoenix Place (South), EC1A 1BB

During November 2016, the Council received a Community Right to Build Order proposal from the Mount Pleasant Association to permit the development of five linked buildings ranging from four to eight storeys (plus lower ground level) which included the following:

  • 125 residential units
  • approximately 1,200 sqm of commercial space
  • over 900 sqm of communal open space
  • new ‘pocket’ park adjacent to Christopher Hatton Primary School

A Community Right to Build Order is a type of planning permission that is prepared by community organisations.

For Orders to be ‘made’, they must first pass an independent examination to decide whether the Order meets a number of statutory requirements. If passed at examination, a referendum to decide whether to make the Order is then held in the neighbourhood area. Once ‘made’, a development can be built in accordance with the Order.

During January 2017, Nigel McGurk BSc (Hons) MBA MCD MRTPI was appointed to hold an independent examination of the draft Order. He found that the Order does not meet all the statutory requirements and therefore should not proceed to referendum.

In accordance with legislation, councils must refuse a draft Community Right to Build Order if this is the recommendation of the Examiner’s report.

Public Hearing

On reviewing the content of the proposed Order and representations received as part of the publication process, Nigel McGurk determined to hold a Public Hearing. The hearing was held at the London Welsh Centre on Monday 20 March 2017.

Additional Viability Information

The below additional information relating to viability was provided to the Examiner at his request on 27 February 2017.

The following representations were received by the Council during the final period of consultation on the Order, held between December 2016 and January 2017. The representations have been forwarded to the Examiner for consideration.
